Crash amputee faces giving ex-wife half 500k compo

A man who won £500,000 compensation after losing a leg in a crash faces losing his home in a divorce battle with his ex.

A judge ruled the property Kevin Mansfield bought and adapted should be included in the 50-50 split of the couple’s assets.

Dad-of-two Kevin, 41, who was given the payout in 1998 to finance living with disability, will have to move if the decision stands or face crippling debts, an appeal court heard yesterday.

Mr Mansfield, who met now ex-wife Catherine five years after the payout, argued the cash must be separate from normal assets.

His barrister Alan Barton said he faces losing his house in Chelmsford, Essex.

Mr Mansfield would have to consider a move to a cheaper part of the country, away from his children. 

 

The lawyer said the judge who made the ruling had paid too much attention to “the ideal situation that the wife would like” and “ignored his needs as a disabled man”.

But yesterday Kevin won the right to appeal against the ruling.

Lady Justice Black said at London’s Civil Appeal Court: “The husband’s disabilities are an important factor.”

The court urged the pair to settle to avoid “potentially enormous legal costs”.

Kevin said: “I want everyone to know it could happen to them. It could happen to any war vet back from Afghanistan. They could get compensation, meet someone years later and have it taken away, its not that I don’t want to support my children but such a huge amount.”
